<strong>Notice</strong> <strong>of</strong> <strong>Intention</strong> <strong>to</strong> <strong>Expropriate</strong><br />
THIS NOTICE OF INTENTION TO EXPROPRIATE is issued in accordance with<br />
section 6 <strong>of</strong> the Expropriation Act, Chapter E-14, <strong>of</strong> the Revised Statutes, 1973.<br />
1. The name and address <strong>of</strong> the Expropriating Authority is the City <strong>of</strong> Monc<strong>to</strong>n, 655 Main<br />
Street, Monc<strong>to</strong>n, New Brunswick, E1C 1E8.<br />
2. A description <strong>of</strong> the land <strong>to</strong> be expropriated is set forth in Schedule “A” here<strong>to</strong>.<br />
3. A general description <strong>of</strong> the state <strong>of</strong> the land described in Schedule “A”, including the<br />
condition <strong>of</strong> any buildings or improvements thereupon is contained in Schedule “B”<br />
here<strong>to</strong>.<br />
4. It is intended that the Expropriating Authority acquire the land described in Schedule<br />
“A” in fee simple and such interest when acquired shall be subject <strong>to</strong> nil encumbrances.<br />
5. The purpose for which expropriation <strong>of</strong> the said land is required is <strong>to</strong> acquire title in fee<br />
simple <strong>to</strong> the land for the expansion <strong>of</strong> the Turtle Creek Watershed.<br />
6. It is the intention <strong>of</strong> the City <strong>of</strong> Monc<strong>to</strong>n, the expropriating authority, <strong>to</strong> expropriate the<br />
lands described in Schedule “A”.<br />
7. A depiction <strong>of</strong> the land described in Schedule “A” is attached here<strong>to</strong> as Schedule “C”.<br />
8. A statement setting out the names <strong>of</strong> all known owners <strong>of</strong> the lands described in<br />
Schedule “A” here<strong>to</strong> is contained in Schedule “D” here<strong>to</strong>.<br />
9. Schedule “E” sets out evidence <strong>of</strong> the steps taken by the City <strong>of</strong> Monc<strong>to</strong>n, the<br />
expropriating authority, <strong>to</strong> ascertain the owners <strong>of</strong> the lands described in Schedule “A”.<br />

- The City <strong>of</strong> Monc<strong>to</strong>n, the Expropriating Authority, has caused the records <strong>of</strong> the<br />
Registry Office <strong>of</strong> the County <strong>of</strong> Albert <strong>to</strong> be searched by an Abstrac<strong>to</strong>r and reviewed by<br />
a Solici<strong>to</strong>r <strong>of</strong> the City <strong>of</strong> Monc<strong>to</strong>n, Legal Department, <strong>to</strong> ascertain the owners <strong>of</strong> the<br />
lands described in Schedule “A”, and has caused the apparent owner <strong>to</strong> be contacted; has<br />
caused the records <strong>of</strong> the Local Assessment Office <strong>to</strong> be searched in an effort <strong>to</strong> obtain<br />
mailing addresses and owner identification; and has found that the owner set out in<br />
Schedule “D” is the owner <strong>of</strong> the lands described in Schedule “A”.
